Legal Tip: Workers' Comp, Medical Care and Your Treating Doctor

DO check with a workers’ compensation attorney before choosing a treating doctor. Your employer is required to provide you with a panel of three doctors to choose from and your workers’ compensation attorney can advise you on your rights and responsibilities regarding your medical care and the choice of a doctor from the panel. DO remember that your treating doctor and not the insurance company, its nurse or its vocational rehabilitation worker is responsible for making medical decisions in your case. If you feel that the insurer or its agents are engaging in inappropriate medical management, contact your workers' compensation attorney. DO request a written referral from your authorized treating doctor for therapy or specialist care. The insurance company may not pay for treatment without a proper referral from your authorized treating doctor.
