Legal Tip: What Happens to my security deposit at the end of the lease?

Generally speaking, in Virginia, if you moved out of the property and left it in the same condition as when you first moved in, except for reasonable wear and tear, and if you have paid the landlord all that you owe for rent and other fees, your landlord must return the security deposit to you.  In most cases, the security deposit must be returned within in 30 to 60 days from the end of the lease.  Be sure to give the landlord your forwarding address so that the security deposit refund can be mailed to you.

If you landlord does not refund your security deposit, it is sometimes helpful to send the landlord a certified letter demanding the refund.  If this does not work, you may be able to file a lawsuit for the refund.
